Order Form & Sales purchase agreement
Terms & Conditions :
1. The Product/s are sold on a “where is / as is basis”.
2. No delivery or installation service is provided by the Seller.
3. The Buyer acknowledges and agree it is the Buyer’s responsibly to check with local Council and State legislation regarding the intended use and occupancy of the Product/s on any property they intend to install the Product/s and rely totally on their own enquiries.
4. The Product/s are manufactured in China and imported into Australia by placing 2 units in a 40ft High Cube Container. While all care is taken some scratches and dents may occur during packing and transit. The buyer has been made aware that this may occur and accepts that the Product/s may have some imperfections.
5. The Seller has invited and provided the Buyer the opportunity to inspect the product before purchasing and/or the Buyer has satisfied themselves with the quality level of the Product/s.
6. A non-refundable deposit of $1,000.00 plus GST is required to secure the product with the balance payable within 7 days. If the product is not in-stock, then the balance is payable within 7 days from when the product is in stock.
7. Pick-up of the Product/s must be done during business hours with a self-loading truck (Hiab or Tilt Tray) capable of carrying the load weight of the Product/s within 14 days of full payment of the Product/s.
8. If the product/s is not picked up within 14 days of full payment, a storage fee of $50.00 plus GST per week will apply unless prior arrangements are made.
9. The Seller makes no claim or guarantee on the suitability of the Product/s for any particular purpose. The Buyer agrees to make their own enquiries and satisfy themselves on the suitability and fit for purpose of the Product/s for the Buyer’s intended use of the Product/s.
10. The Buyer acknowledges and agrees the Seller has advised to use suitably qualified & experienced tradespersons to install the Product/s.
11. A licenced electrician must be used to connect the Product to mains power, to install/inspect any light fittings, power points, light switches, fire alarm/s (not supplied) and to complete the final electrical certification of the Product/s.
12. A licensed plumber must be used to connect the Product/s to water supply, sewerage system, install/inspect any plumbing or gas fitting (if applicable) and complete a final plumbing (and gas if applicable) certification of the Product/s.
13. The Seller makes no claim that the Product/s meets any State or Territory building codes.
14. Any advice, recommendations, information, assistance or service given by the Seller in relation to the Product/s is given in good faith and believed to be accurate, appropriate and reliable at the time it is given, but is provided without any warranty or accuracy, appropriateness or reliability and the Buyer will indemnify Seller against any loss suffered from the Buyer’s reliance on such advice, recommendation, information, assistance or service.
15. The Buyer acknowledges that they may be required to modify, repair, replace or purchase additional items or components to make the product fit for purpose for their intended use.
16. The Buyer acknowledges and agrees that the product is being sold at a discounted price and excluding what is required by law there is no warranty or guarantee on the product.
17. The Buyer acknowledges and agrees that the Seller will not, under any warranty or guarantee, be responsible for any damages including but not limited to, inconvenience, loss or damage to personal or third-party property, loss of use, loss of revenue, hire/rent costs, relocation costs, delivery costs, installation costs, whether direct, indirect, incidental, consequential, economic damages whether arising in contract or tort.
18. The Buyer acknowledges and agrees to indemnify the Seller against any claim brought against the Seller by any actions of the Buyer purchasing, transporting, placing on a property, engaging in the installation process and use of the Product/s.
19. The title of the Product/s is not transferred to the Buyer until cleared funds are received in full.
20. This Sales Purchase Order Agreement shall be governed by and constructed in accordance with the laws of NSW.
